Ecotrade Europe Ltd, a company registered in England and Wales (company number 07094786) whose registered office is Unit 13 Lawnhurst Trading Estate, Oakhurst Drive, Stockport, Cheshire, SK3 0XT (“Beauty Works”, “we”, “us”, “our”) will from time to time offer digital gift cards to redeem against our goods and products (“Gift Card”) which can be used by you as a customer (“you”) subject to the following terms and conditions:.
1.Eligibility and retail use
By purchasing or adding a Gift Card to your Beauty Works account, you accept these terms and conditions, the terms of sale and terms and conditions of our website, as updated by us from time to time. Corporate, employee, customer-incentive or bulk purchases require Beauty Works’ prior written approval and may be subject to separate terms.
Beauty Works Gift Cards are intended for purchase and use by UK retail consumers purchasing for personal, non-commercial use. They are not intended for trade, wholesale, salon, professional, business -procurement, resale or commercial promotional purposes. A Gift Card may be given as a personal gift to another specified individual during the purchase process, or shared informally with a recipient of the customer's choosing after purchase by passing on the Gift Card code, but may not be resold or transferred commercially. Beauty Works is not required to verify the identity of anyone redeeming a Gift Card code and may treat the person redeeming it as entitled to do so, except where Beauty Works reasonably suspects fraud or unauthorised use.
2. Gift Card format, value and delivery
Gift Cards are digital gift cards denominated in pounds sterling. The available value of the gift card is shown at purchase and in the balance when logged into a user account. The Gift Card will be sent to the email address provided on the product page. Customers are responsible for providing a correct and valid email address and for keeping the Gift Card number or redemption code secure. Beauty Works cannot accept responsibility for a Gift Card sent to an incorrect email address supplied by the customer, except where the issue results from Beauty Works’ own error or breach of legal duty.
3. Where and how Gift Cards may be used
Gift Cards may be redeemed only at beautyworksonline.com [BM3.1]and only for eligible purchases made through the UK website. They cannot be used in Beauty Works salons[BM4.1], concessions, third-party retailers, events, or any other website or service unless Beauty Works expressly states otherwise. Customers can use their Gift Card balance only by creating a Beauty Works customer account, logging in, and adding their Gift Card code to that account.
Gift Cards:
• may be used over multiple transactions;
• may be combined with another payment method where the order value exceeds the Gift Card balance;
• cannot be exchanged for cash or credit;
• cannot be used to purchase another Gift Card; and
• cannot be used for any products or services specifically excluded on our website.
• can only be redeemed while our website and account systems are available. We will take reasonable steps to keep these systems available, but we are not liable for a Gift Card temporarily being unable to be redeemed because of a website or system outage beyond our reasonable control, provided we restore access within a reasonable time and this does not reduce the value or validity period of the Gift Card. This clause does not exclude or limit any liability that cannot lawfully be excluded or restricted.
4. Validity and balance
Gift Cards are valid for 12 months from the date of issue. The expiry date will be shown on the Gift Card or accompanying email. Any remaining balance must be used before the expiry date. Once the Gift Card expires, any unused balance will be cancelled and cannot be redeemed, extended or exchanged for cash. Customers can check their Gift Card balance only by creating a Beauty Works customer account, logging in, and adding their Gift Card code to that account. Customers are responsible for keeping their account login details and Gift Card code secure. Adding a Gift Card to an account does not extend its expiry date. No interest or other return is payable on Gift Card balances.
5. Returns, cancellations and refunds
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you can cancel your contract with us for the Gift Card that you purchased, and obtain a full refund, if you notify us that you wish to cancel no later than 14 days from the date you receive the Gift Card. You do not need to give us any reason for cancelling your contract nor will you incur any penalty.
Where goods purchased using a Gift Card are returned under Beauty Works’ discretionary returns policy, any approved refund will normally be credited back to the Gift Card or issued on a replacement Gift Card. Where an order was paid partly by Gift Card and partly by another payment method, any refund will be allocated between those payment methods in accordance with the applicable returns [GH11.1]policy and legal requirements. Refunds for faulty, misdescribed, incorrectly supplied or otherwise non-conforming goods will be handled in accordance with the customer’s rights. Nothing in these terms excludes or restricts any statutory rights or remedies available to consumers, including rights under the Consumer Rights Act 2015 and applicable online cancellation rights. Beauty Works will not exclude or restrict liability that cannot lawfully be excluded or restricted, including liability relating to goods, digital content or services that are faulty, not as described, not fit for purpose or not supplied as agreed.
6. Lost, stolen or misused Gift Cards
Gift Cards should be treated like cash. Beauty Works is not responsible for unauthorised use after delivery where the customer has failed to keep the Gift Card details secure. If a Gift Card is lost, stolen, deleted or not received, the customer should contact our customer service team via the https://beautyworksonline.com/help-centre page as soon as possible and provide proof of purchase. Where a Gift Card has not been redeemed, Beauty Works may, where reasonably possible, cancel and reissue it after verifying the customer’s identity and purchase details. Beauty Works is not required to replace a Gift Card that has already been redeemed. This clause does not exclude liability for Beauty Works’ own error, fraud, negligence or breach of statutory duty.
7. Promotional offers
Gift Cards may not be used with a promotional offer, discount code or other benefit [BM14.1]where the relevant offer terms expressly exclude Gift Card use.[JC15.1] Any such exclusion must be made clear before the customer uses the promotion. Unless expressly stated otherwise, Gift Cards cannot be purchased using a discount code or promotional offer.
8. Fraud, resale and suspension
Beauty Works may temporarily suspend a Gift Card where it reasonably believes fraud, misuse or unlawful activity has occurred. Beauty Works will investigate promptly, and where appropriate, restore the Gift Card and its remaining balance without delay.A Gift Card will not be cancelled solely on the basis of an unsubstantiated suspicion. Where a suspension or cancellation is found to be incorrect, Beauty Works will restore the Gift Card or provide an appropriate remedy, subject to applicable law. Customers may contact customer services to request a review of a suspension decision.
9. Changes or withdrawal of the Gift Card scheme
Beauty Works can always change the Gift Card Scheme where necessary to
•to implement minor technical adjustments and improvements, for example to address a security threat or correct errors or omissions in any information or document, provide that doing so does not materially affect your use of the products or your rights; and •comply with legal requirements, prevent fraud or misuse or maintain security. Where a change will materially affect a Gift Card that has already been purchased, we will give you at least 30 days' notice by email or through your Beauty Works account before the change takes effect. , except where a shorter period is necessary to address a security threat, prevent fraud or comply with a legal requirement.
